These terms and conditions, as amended from time to time and any other terms or conditions set by BP and notified either on the web site or to you, the Customer, apply to all transactions between you, and BP. Please click “Agree” to confirm your acceptance. Any other use is in breach of these terms.

 

Your use of the Internet-based Doorbell App is authorised by a password provided on purchase and is sold on the basis of the specifications applicable at the time of purchase of the unit (which includes “product” or “device” and the App via the website).  The customer must maintain the confidentiality of the password and ensure that use is in accordance with the instructions and warnings provided either with the product or on the website.  BP will take all reasonable steps to secure access via the password and ensure that the product matches the description of the unit sold, but will not be liable for any damages (including consequential damages such as loss of profits) either through breach of the password protection or failure or lack of any other security measure, or in consequence of any defect in or lack of functionality of the product, unless the loss is caused deliberately or by gross negligence – in either case by or attributable to BP – in which case BP will accept liability for direct loss but not consequential damages of any kind.  This is further explained below.

 

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE PRODUCT IS WITHOUT WARRANTY AND AT YOUR SOLE RISK. YOU ARE NOT RELYING ON ANY REPRESENTATIONS AS TO QUALITY, FUNCTIONALITY OR OTHER ATTRIBUTES SAVE FOR ANY WRITTEN GUARANTEES PROVIDED BY BP.  SUBJECT TO THE CONSUMER PROTECTION ACT, THE UNIT AND THE APPLICATION, AND ANY SERVICES PERFORMED OR PROVIDED BY THE APPLICATION, ARE PROVIDED “AS IS” AND “VOETSTOOTS”.

 

TO THE EXTENT NOT PROHIBITED BY LAW, BP SHALL NOT BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS.

 

Each unit has a unique ID number enabling BP to identify it.  This number must be noted by the Customer and registered via the BP website in order to secure the warranty of 1 year that is offered in addition to all statutory and common law rights.  The warranty is void if the unit is opened by an unauthorised person as shown by damage to the protective sticker.

 

BP reserves all its and its suppliers’ copyright and Intellectual Property (IP) rights in the App and the product.  Use of the product or the App does not constitute a grant or waiver of any rights of the copyright or IP owners save to the extent necessarily implied by use of the functionalities or features offered.  The IP in the unit and the website, to the extent necessary, is licensed, not sold, to you.  The rights are not transferable without our written consent.  If you intend selling your property, please contact us for further information.

 

The Customer may not modify, tamper with, disable or circumvent any security technology included with the App or the device and may not modify, or use modified versions of, any software supplied by BP.  The product must be installed and used in accordance with the User Guide and Instructions.

 

The Customer agrees to the Policies as posted to the BP website from time to time.  These may cover such aspects as Privacy, Security and Payment.  With regard to Payment, BP uses PayGate and accordingly their terms and conditions apply as well.

 

Where any order is placed or registration is performed on the BP website by a prospective re-seller, the acceptance of these Terms and Conditions shall apply to all subsequent sales, whether via the website or through direct orders.  This term will continue to apply until terminated in writing by either party.

 

Where commercial companies (including re-sellers) register or order, these Terms and Conditions shall take precedence over any Terms and Conditions applicable to their business transactions, unless BP shall have expressly agreed in writing to such other Terms and Conditions.

 

The Customer acknowledges and agrees that, apart from the general exclusions of liability herein, BP will not be responsible for any loss or damage directly or indirectly due to any of the following:

• power outages or faults
• internet connection being absent or unreliable
• incompatibility with an existing or new alarm system or other linked electronic devices
• theft of, or tampering with, the unit
• water ingress, or rust caused by salty conditions (protective housing is not part of our offering)
• LAN cable or power connections problems

 

The Customer agrees that, where BP undertakes installation of the unit, to ensure convenient access and all reasonable facilities, such as parking and power supply, to any staff member or contractor that is tasked to do the installation.

 

Any security company that registers with BP with the intention of supplying and installing units supplied by BP is deemed to warrant the following:-

• It is a member in good standing of PSIRA (Private Security Industry Regulatory Authority)
• Any employee who may be deployed to a Customer has a current police clearance
• A job card signed off by the Customer confirming completion the work to the Customer’s satisfaction will be obtained promptly on completion of the job and copied to BP
• Any issues relating to workmanship will be resolved with 48 hours
• The company’s workmanship is guaranteed for 1 year
• Payment terms are 7 days from receipt of invoice
• If the security company has been authorised to advertise its services as an accredited re-seller of BP products, they are not selling any other similar devices and will not do so until expiry of 1 year after the last purchase from BP.

 

All transactions completed on the website are final. If technical, supplier or other problems prevent, or unreasonably delay, delivery of any goods, your exclusive remedy, after giving BP final written warning of cancellation, is a refund of the price paid.

 

The units supplied by BP are only for personal, non-commercial purposes.

 

This agreement is subject to the law of South Africa.  BP only sells to Customers and arranges delivery within the borders of South Africa.

 

This agreement, together with the specific purchase and identity details, constitutes the entire agreement between you and BP and governs your use of the device and the website, superseding any prior agreements with respect to the same matters.  No BP employee or agent has the authority to vary any of these terms and conditions.
